    The fundamental difference between pre-grant opposition under Section 25(1) and the post-grant opposition under Section 25(2) is that the provision of section 25(1) can be invoked by any person. But a post-grant opposition can only be made by the &#39;locus standi&#39; (the person inereestertd ie. who is financially affected, aggrieved or concerned by the working of the patent). In my opinion, there is nothing wrong in seeking a writ remedy against a pre-grant order if public interest is his/her concern.
